The Wisconsin Fair Employment Act (WFEA) prohibits discrimination based on age, race, creed, religious observance or practice, color, handicap, marital status, sex. national origin, ancestry, arrest record, conviction record, membership in the National Guard, state defense force or any reserve component of the military forces of the United States or this state, unfair honesty testing, sexual orientation and sexual harassment.
The employee must file a complaint of discrimination within 300 days of the employer’s discriminatory act. If the complaint is not filed by the deadline, the employee’s claim may be barred and the remedies waived.
Employers who engage in employment discrimination must pay their employees compensatory and punitive damages pursuant to the Equal Pay Performance Act. The law, which amended the Wisconsin Fair Employment Act on June 8, 2009, provides that an employee may recover compensatory damages for future economic losses and for pain and suffering, emotional distress, mental anguish, loss of enjoyment of life, and other noneconomic losses, in addition to punitive damages in amounts that may not exceed the following, as indexed for inflation:
A company that employs 100 or fewer employees, $50,000;
more than 100 but fewer than 201 employees, $100,000;
more than 200 but fewer than 501 employees, $200,000; and
more than 500 employees, $300,000.
